1. Who we are
“Bidding Is Open,” “we,” “us,” and “our” refer to Retro Industries Inc. doing business as Bidding Is Open. Darrien Eouse is a Florida auctioneer, FL AU#4535. Specific auction advertisements and live catalogs provide the event-specific identity, license, buyer’s-premium, schedule, and other disclosures that apply to that sale.
2. Website use
This website provides general information about our business, buyer process, fulfillment, and potential consignments. You may use it for lawful personal and business inquiries. You may not interfere with the site, attempt unauthorized access, submit malicious code, impersonate another person, or use contact forms for spam or unlawful solicitation.
3. Auction platform and accounts
Bidding occurs through HiBid, a third-party platform with its own account and platform terms. You are responsible for maintaining accurate registration information, protecting your login, and reviewing the auction-specific terms before participating. Technical access to the platform does not guarantee bidder approval, acceptance of a bid, or purchase of a lot.
4. Bids are binding
A bid is an offer to purchase the lot under the auction terms. Bids are binding. Review the lot, amount, buyer’s premium, applicable sales tax, pickup or shipping implications, and all auction terms before confirming a bid. Do not bid as a placeholder or on behalf of another person without proper authority.
5. Lot descriptions and condition
Lots are sold as-is, where-is. Photographs and descriptions are provided to help bidders evaluate the property, but they do not replace your own inspection and judgment. Normal signs of age, use, repair, restoration, reproduction, variation, or other condition may exist. Each lot identifies vintage, original, or reproduction status based on the information reasonably available to us; no statement should be read beyond the specific language and evidence in that listing.
Ask material questions before bidding. Measurements may be approximate. Color, scale, and condition may display differently across devices. Unless expressly stated in the specific catalog, a lot description is not a guarantee of future performance, fitness for a particular purpose, or third-party attribution.
6. Buyer’s premium, tax, and payment
Our current standing buyer’s premium is 18% of the hammer price. The exact buyer’s premium for a specific event must be stated in that auction advertisement and live catalog. Applicable sales tax is added to taxable purchases unless an accepted exemption applies under the event process.
The card associated with registration may be authorized as part of bidder approval. If you win, the card on file is automatically charged for a valid winning invoice after the auction closes, subject to the specific event terms and any alternative arrangement approved before the auction. Winning invoices are expected to settle within 72 hours. A failed charge or unpaid invoice does not cancel the bidder’s obligations.
7. Pickup and shipping
Pickup is by confirmed appointment at 217 Capitol Ct, Ocoee, Florida 34761. Buyers are responsible for arriving within the applicable pickup window with appropriate vehicle capacity, labor, packing materials, and securement. Contact us before pickup if another person will collect property for you.
Shipping is available on all lots at actual cost with no markup. Shipping is separate from the winning invoice: we select an appropriate method based on the packed item and destination, send a quote for approval, and collect the shipping charge after approval. Shipping time, carrier service, and tracking depend on packing requirements and carrier operations. The event terms and approved shipping communication govern the transaction.
8. Consignment and professional inquiries
Submitting a Sell With Us, professional, or contact form is only an expression of interest. It is not an appraisal, listing, agency relationship, statutory consignment agreement, authorization to sell, acceptance of property, promise of a sale, or guarantee of value. Any consignment requires a separate written agreement signed by the required parties after scope, authority, fees, property, timing, and responsibilities are confirmed.
9. Third-party links
The site links to HiBid, social networks, Trustpilot, and other external resources. Those services control their own content, availability, privacy practices, and terms. A link does not make us responsible for an external service.
10. Educational content
News and guide articles are general educational information, not legal, tax, appraisal, investment, restoration, authentication, or shipping advice. Sources are offered for further reading. Circumstances and platform rules change; verify the active catalog and applicable requirements before acting.
11. Availability and corrections
We may correct errors, update content, restrict access, or change general site information. The website may be unavailable from time to time. If you see a material issue, contact help@biddingisopen.com.
